Aquittal following Speeding and Failing to Identify a Driver Prosecution

Laura Newton, motoring solicitor, represented a driver who had been served with a Notice of Intended Prosecution following an allegation of speeding. He recalled that both he and his wife had shared the driving on that particular journey and neither could recall who was driving at that the time. They were advised by Laura not to guess, as if they were incorrect there could be serious repercussions. The car owner was summoned to Court for Speeding and also Failing to Identify a Driver. If convicted, 6 points would have been imposed on his licence. At Court we were able to persuade the Court that he could not reasonably have identified who was driving. He was found not guilty of all charges and his legal costs were repaid by the Court under a Defence Costs Order.
