Silly String Obscures Speed Sign – Special Reasons – No Points Imposed

Motoring Solicitor Laura Newton represented a driver who had missed a change in speed limit due to the sign being obscured by silly string and inadvertently exceeded the limit by 20mph. He was required to attend Court under the Single Justice Procedure as the speed to was too high to be dealt with by Fixed Penalty. Although he pleaded guilty, the Court allowed the driver to give evidence about the circumstances in a Special Reasons hearing. The Court agreed that, although the driver was technically driving in excess of the limit, he should not have any points on his licence. He was not asked to pay any fine.
