This HGV driver, having accumulated 12 penalty points for speeding offences, risked a 6-month disqualification as a ‘totter’. He was represented by Millicent Dooher, barrister, at his hearing before the Magistrates Court.
Having been advised on all the options, this driver had hoped the Magistrates would impose a shorter period of disqualification, rather than no disqualification if exceptional hardship were to be accepted. The Court did accept exceptional hardship and were convinced to deal with this matter by way of a short disqualification, meaning this driver will have 0 penalty points on his licence at the end of the disqualification period rather than 12 penalty points for the next 3 years.
