Successful s.172 trial: Unable to identify driver between husband or wife.
Millicent Dooher represented this client at their Magistrates Court trial for failing to identify the driver of a vehicle following a speeding offence. The defence for this charge is whether the recipient has acted with reasonable diligence in ascertaining the identity of the driver and providing it to the police. In this instance, the client could not identify whether it was her or her husband who was driving the vehicle at the time of the offence. Following a trial on this matter, the District Judge accepted the evidence, and found that no offence was committed. The defendant was found Not Guilty, and the Court awarded costs to the defendant.
