Driver Wins Private Hire Appeal in Magistrates’ Court

Our client, a Private Hire Driver, instructed Smith Bowyer Clarke to represent him following the refusal of his Private Hire Licence renewal. His licence has been refused on several grounds. Under Transport for London Policy, any convictions or penalties must be reported within 48 hours. However, our client had been sentenced for two separate offences of careless driving and had failed to report either of them until the Licence renewal. Jaskiran Pal assisted our client in initially lodging an appeal and securing a temporary extension to the Private Hire Licence pending Appeal. This allowed the driver to continue working after his licence had expired. We thoroughly prepared our client’s evidence and advised on steps to be taken to strengthen his appeal, including additional training and references. Following a Hearing at the City of London Magistrates’ Court, the Appeal was allowed. The Court agreed that our client was a fit and proper person and granted the Licence application.
