This appeal was brought against a Local Authority following the Driver’s application being refused due to a 3 penalty point motoring offence. The Local Authority had quoted their guidelines that suggested that a driver must have a clean licence for 3 years before being able to be approved as a PHV driver in this area. Barrister, Millicent Dooher, was able to have the matter reviewed before appeal. The authority accepted the driver ought to be licenced and issued his licence within 7 days.
