Fail to Identify a Driver Case Dropped

Our client was represented by Laura Newton in relation to an offence of Failing to Identify a Driver. Our client was a former director of the Registered Keeper of the vehicle, which was a limited company. She had replied to the Notice, but was unable to give the name of the particular driver. We had identified procedural issues with the service of the Notice as well as a statutory defence.

The case was listed for trial. Prior to giving evidence, the Prosecutor agreed with the legal arguments and dropped the case offering no evidence. The Court dismissed the case without our client needing to give any evidence in Court and  they ordered a costs order to allow our client to reclaim her legal costs.
