Lowest Sentence After Plea to Fail to Provide

Laura Newton represented a driver who had been stopped by the police following an observed period of poor driving. The police suspected that he was under the influence of alcohol and roadside breath sample produced a reading of 89mg of alcohol in his breath. He was arrested and taken to the Police Station, but failed to provide an evidential sample on the Lion Intoxilyser. He was charged and bailed to attend at the Magistrates’ Court for Failure to Provide a Specimen.

At Court, his mitigation and remorse were outlined in detail and the Court was persuaded to impose the lowest sentence, which was a fine and a 12 month disqualification. The driver was given the opportunity to reduce the ban to 9 months with the Drink Drive Rehabilitation Course.
