Private Hire Driver Found Not to Be “Plying for Hire” by Magistrates on Appeal
Laura Newton represented our client, a TfL licensed Private Hire Driver, whose licence had been revoked. He was alleged to have been plying for hire during an undercover operation by TfL licensing officers. This decision was appealed to the Magistrates’ Court in the City of London. Mr Hussein attended Court and gave evidence and disputed that he had been touting or plying for hire. The Magistrates’ agreed with our client’s evidence and overturned the decision. They agreed that TfL was wrong, the driver was still a fit and proper person and his licence was restored.
