Successful Exceptional Hardship Argument After Two Cases Tied Together

Laura Newton represented a driver who had been called to Court facing a totting up ban due to excess points on his Licence. We had initially been required to tie two cases in different traffic areas together, to give the driver an effective opportunity to present exceptional hardship. If the offences had been dealt with separately, he could not argue this for each offence on difference occasions. The Court was presented with evidence of the impact of a disqualification in terms of financial impact and the ability to continue family caring commitments. The Court agreed that exceptional hardship would be caused by a 6 month ban, they therefore imposed the points but did not impose any disqualification.
